This course offers a review of all aspects of wetlands regulation, focusing on Section 404 of the Clean Water Act. Topics include the jurisdictional scope of section 404, how permitting decisions are made, and the substantive requirements that Section 404 permits impose. The course also considers how Section 404 is enforced, and how its requirements intersect with private property rights.

Course Structure: Professor Johnston will video-record the lectures in advance and will post them online in Moodle. Students can access these videos on demand in accordance with the two week class schedule. Students will also be expected to participate in scheduled online class discussions (written Q&A) and scheduled live video chats. Total minutes of instruction will comport with ABA requirements for a two credit course and include live chats, online discussions, and lectures. Students are also expected to spend at least 60 hours of time with readings and course preparation in addition to the lectures and discussions. Professor Johnston will also be available for student questions via email and phone.

 

There will be a two hour exam on Monday, June 27th.

The American Bar Association accreditation standards require students to regularly attend the courses in which they are registered. Lewis & Clark expects students to attend classes regularly and to prepare for classes conscientiously. Specific attendance requirements may vary from course to course. Any attendance guidelines for a given class must be provided to students in a syllabus or other written document at the start of the semester. Sanctions (e.g., required withdrawal from the course, grade adjustment, and/or a failing grade) will be imposed for poor attendance.
